Distance Sales Agreement

1. Parties

This Distance Sales Agreement ("Agreement") has been concluded between the Seller and the Buyer, whose information is provided below, within the framework of Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

2. Subject of the Agreement

The subject of this agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the digital service subscription purchased by the Buyer through the TourOperation.com platform owned by the Seller.

3. Service Information

The basic characteristics, sales price and payment method of the service are specified on the platform during order confirmation. The scope of service varies according to the selected subscription plan.

• Service Type: Cloud-based tour operation management software (SaaS)
• Delivery Method: Digital — instant access provided after payment confirmation
• Subscription Periods: Monthly or annual

4. General Provisions

• The Buyer acknowledges that they have read and are informed of all preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the service subject to sale, and that they have given the necessary consent electronically.
• The Seller is responsible for delivering the contracted service in a sound, complete manner and in accordance with the ordered specifications.
• If the Seller realizes that the ordered service cannot be provided before delivery, they are obligated to immediately inform the buyer and refund the payment within 14 days.

5. Right of Withdrawal

The Buyer has the right to withdraw from the agreement within 14 (fourteen) days from the date of purchase without providing any justification and without paying any penalty (Law No. 6502, Article 50). To exercise the right of withdrawal, written notification to [email protected] within this period is sufficient.

• The total amount paid by the Buyer will be refunded within 14 days.
• The refund is processed through the intermediary institution (credit card, bank) used for payment.
• Platform access is terminated upon exercise of the right of withdrawal.

6. Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised in the following cases (Distance Contracts Regulation, Article 15):

• In services where performance has begun with the Buyer's consent within the withdrawal period, if the service has been fully performed.
• In services performed instantly in electronic environment, the right of withdrawal is not accepted after delivery; however, TourOperation provides a 14-day full refund guarantee.

7. Payment & Security

• Payments are processed securely through PayTR payment infrastructure.
• Credit card information is not stored on TourOperation servers; it is processed directly by the payment service provider (PCI DSS compliant).
• All communications are protected with SSL/TLS encryption.

8. Protection of Personal Data

Personal data belonging to the Buyer is processed and protected within the framework of the Turkish Personal Data Protection Law No. 6698 (KVKK) and the Platform's Privacy Policy.

9. Dispute Resolution

Turkish Republic laws apply to disputes arising from this agreement. Consumer Arbitration Boards and Consumer Courts of Antalya have jurisdiction. For consumer complaints, applications may be made to provincial or district consumer arbitration boards within the monetary limits announced annually by the Ministry of Commerce, or to consumer courts for amounts exceeding these limits.

10. Effectiveness

This agreement enters into force upon electronic approval by the Buyer. The agreement text is accessible at all times through the platform.
